1. Definitions:

1.1. “You After X”, “The Split Australia”, “YAX”, “TSA”, “BufferZoneX”, “Buffer Zone" "youafterx.com", “This Website”, “The site”, “we”, “our” or “us” refers to the You After X website and app platform owned and operated by The Split Australia Pty Ltd, its Owner, Moderators, Developers and Staff.

1.2. “Owner” refers to The Split Australia Pty Ltd, a company registered in Australia under the Australian Corporations Law.

1.3. “You”, “your”, or “user” refers to you as an individual user of this website and any related services.

1.4. “Content” refers to any information accessible on this website, including but not limited to: Pages, Articles, Courses, Files, Images, User Accounts, Advertisements, Posts, Questions, Comments, Notifications, and external resources to which a link has been posted.

 

2. Removal of Content:

2.1. We reserve the right to remove any Content that we deem inappropriate or consider to be a violation of the terms outlined in this document including a contradiction to any part of our Code of Conduct. 

2.2. We reserve the right to remove any piece of Content at our sole discretion without notice.

If at any time YAX chooses, in its sole discretion, to monitor the Content, YAX nonetheless assumes no responsibility for the Content, no obligation to modify or remove any inappropriate Content and no responsibility for the conduct of the user submitting any such Content. You are solely responsible for the Content that you post on or through YAX, any material or information that you transmit to other users and for any interactions with other users.

2.4. You agree that you will not use YAX to send or post Content of any kind or nature that is unlawful, harassing, libellous, defamatory, abusive, threatening, harmful, vulgar, obscene, profane, racially offensive, inaccurate, or otherwise objectionable material or that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, federal or international law or regulation. You agree not to use YAX to distribute or send any illegal Content of any kind. Posting illegal Content or participating in any form of discussion with the intention to commit any illegal activity is strictly prohibited. YAX reserves the right to take appropriate legal action, including, without limitation, referral to law enforcement, for any use that YAX deems in its sole discretion to be an illegal or unauthorized use. YAX will cooperate fully with any law enforcement officials and/or agencies in the investigation of any person(s) who violate the terms of this Agreement.

2.5. We reserve the right to ban or block any user from accessing or using the website, Content, communication tools, or any related services.

3. Data Use & Privacy:

3.1. The privacy of information you provide to us when using this site is important to us, as is the safety of each one of our users.

3.2. 3.4. If you wish for removal of any data you have supplied, please send a removal request via our contact form which should include the following information: a link to your user account, a link to the Content(s) in question and a message describing the exact Content you wish to have removed.

3.5. YAX does not knowingly collect or solicit personal information from anyone under the age of 18 or knowingly allow such persons to register for YAX. If you are under 13, please do not attempt to register for YAX or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 18 may provide any personal information to YAX. In the event that we learn that we have collected personal information from a child under age 18 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 18, please contact us.

3.6. The use of false or misleading personal information is strictly prohibited. Your user account must contain your real name upon creation and information. If you do not wish your real and true personal information to be published in relation to your Content, please use the anonymous feature (see section on anonymity). YAX reserves the right to take action against user accounts that do not represent a real person, including but not limited to, the actions specified under “Removal of Content”.

3.7. We may contact you, by email or other means; for example, we may send you promotional offers on behalf of other businesses, or communicate with you about your use of the Website. Also, we may receive a confirmation when you open an email from us. This confirmation helps us make emails more interesting and improve our service. If you do not want to receive email or other mail from us, please indicate your preference by changing your account settings accordingly, contacting us, or by clicking the “unsubscribe” link in an email we send to you.

3.8. When we collect usage information (such as the numbers and frequency of visitors to the Website), we only use this data in aggregate form, and not in a manner that would identify you personally. For example, this aggregate data tells us how often users use parts of the Website, so that we can make the Website appealing to as many users as possible. 3.1.1. YAX also implements Google Remarketing and collects Google Demographic and Interest data. None of this data contains personally identifiable information. To opt-out of this kind of tracking: please use the tool provided by Google.

 

4. Anonymity:

4.1. When you are submitting Content on this website, the Content will be displayed to all users of the site, excluding YAX administrators, who have access to all Content and user data for moderation purposes.

4.2. By submitting Content anonymously or otherwise, you agree to follow the terms outlined in this document, and have read and are conducting the type of behaviour outlined in our Code of Conduct. 

4.3. Anonymous Content that violates these terms or the Code of Conduct will be associated with the user account that created the Content anonymously and action may be taken against this account or its Content, including, but not limited to, the actions described in the “Removal of Content” section of this document.

4.4. As with all software: this website is subject to errors, bugs and limitations. YAX cannot be held responsible for errors or bugs that may potentially reveal personal information, regardless of the issue’s origin. If you find that any personally identifiable information has been revealed as a result of the website’s functionality, please contact us.

 

5. Disclaimer:

5.1. The views and opinions expressed in the Content belong solely to the Content’s author. Content does not necessarily reflect the views of YAX. 

5.2. Any product claim, statistic, quote or other representation about a product or service should be verified with the manufacturer, provider or party in question. 

5.3. YAX accepts no responsibility for any negative event occurring from the acceptance of advice or instructions offered in the Content. The Content must not be accepted or advocated as professional advice.

6. Advertising Disclosure:

6.1. YAX or the owner may be compensated to provide opinion on products, services, websites and various other topics. Even though YAX may receive compensation for posts or advertisements, we aim to always give honest opinions, findings, beliefs, or experiences on those topics or products.

6.2. Where the compensation has a direct influence on Content, it will be clearly identified as paid or sponsored Content.

6.3. YAX is happy to consider requests for sponsored posts, paid advertising and suitable items that will appeal to our readers for giveaways.  Any such requests need to be in keeping with the general themes of this blog.

8. Indemnity

8.1 You will indemnify and hold YAX, its parents, subsidiaries, affiliates, officers and employees, harmless (including, without limitation, from all damages, liabilities, settlements, costs and attorneys’ fees) from any claim or demand made by any third party due to or arising out of your access to the Services, use of the Services, the violation of this Agreement by you, or the infringement by you, or any third party using your account, of any intellectual property or other right of any person or entity.

 

9. Online Purchasing

9.1 All financial transactions made with this website are non-refundable unless explicitly stated. If you feel you have purchased something un-intentionally or believe you have been incorrectly charged: please contact us.

9.2 In the case of purchasing attendance to a YAX event or conference: you are encouraged to obtain sufficient ticket or travel insurance to cover you for the instance where you are unable to attend the event for reasons including: illness, transport failure or delay or you choose not to attend the event.
